RENTAL AGREEMENT
BOOKING ARRANGEMENTS
1.1 A deposit of 40% of the value of the stay (minimum $500) is required at time of booking as a down payment. This amount will be charged on the Tenant’s credit card and the reservation will be confirmed by email as soon as the transaction is completed. Final payment will be charged on the same credit card 30 days prior to the arrival.
1.2 For any reservation made less than thirty (30) days prior and up to (15) days prior to the arrival date, the full amount will be charged on the Tenant’s credit card. For any reservation made less than thirty (15) days prior to the arrival date, the full amount must be paid by Interac transfer toà info@hebergia.ca.
1.3 Two days prior to the arrival date, a $1000 security deposit will be frozen on the Tenant’s credit card. This security deposit may be used to compensate Hébergia and / or the Owner for any damage caused by the Tenant to the rented premises. This security deposit will be released in the days following the end of the stay.
1.4 The minimum age to make a reservation is 25 years old. Proof of identity may be required.
1.5 As part of the COVID-19 pandemic, the tenant agrees to comply with the public health rules in force and understands that these are mandatory. covid19/

CANCELLATION POLICY
2.1 All cancellations must be made by writing to info@hebergia.ca.
2.2 If the cancellation is made less than 30 days before the date of the beginning of the stay, the Tenant will
be fully responsible for his reservation and no refund will be granted.
2.3 If the cancellation is received more than 30 days before the date of arrival, t he deposit is not refundable.
2.4 These amounts cannot be used as a deposit for a subsequent rental, unless Hebergia succeeds in renting to another Tenant at the same cost for the duration of the stay. In such a situation, an administrative fee of 10% of the value of the stay, for a minimum of $ 75, will be deducted from the amount and the balance will be given to you in the form of a credit note.

RESPONSIBILITY OF HÉBERGIA
3.1 Hébergia is committed to providing the unit with all its furniture, bedding, crockery, lingeries and accessories necessary for the use of the property
3.2 Some items are included in limited quantities only: Toilet Paper, Garbage Bags and Dishwashing Soap.
3.3 The following items are not included: facial tissues, paper towels, laundry soap, soap and shampoo, bathrobe, additional spa towels, firewood.
3.4 Hébergia can not be held responsible for any accident, injury or illness that may occur to the Tenant or his guests during the stay. By accepting this reservation, the Tenant and his guests accept the risks associated with their stay.
3.5 Hébergia can not be held responsible for the theft or loss of the property of the Tenant or his guests during the stay.
3.6 Hébergia will not give any refund or credit note to the Tenant for early departures or late arrivals.
3.7 Hébergia will not give any refund or credit note to the Tenant due to problems due to weather hazards or the degradation of the quality of any body of water located near the residence, as well as any unforeseen interruption of electricity services, supply of running water, gas that would occur during the stay.
3.8 Hébergia and / or the Owner reserves the right to inspect the premises without notice and to execute the urgent work required.

RESPONSIBILITY OF THE TENANT
4.1 The Tenant is responsible for property damage occurring in or on the leased property during the rental period, and for any reason whatsoever, caused by himself or any of his guests, directly or indirectly. The Tenant agrees to indemnify and save harmless Hébergia from any claim by any person resulting from damage which he is responsible.
4.2 The Tenant is held responsible for the actions of any other person on the rented premises.
4.3 The Tenant must notify Hébergia of any breakage or damage caused during his stay, as well as any defects found during the rental period.
4.4 The Tenant may not assign its rights under the lease or sublet the property.

CONDITIONS, ADDITIONAL FEES AND PROHIBITIONS
The Tenant agrees that the following amounts will be retained from the deposit, in the following cases:
5.1 Cleaning after stay is included in the rental, but an additional fee of $ 150 will apply in the event that the property is left in a particularly unclean situation. Example: Dirty dishes, garbage and garbage on the property, items left in the fridge, BBQ not cleaned.
5.2 We ask you to properly sort out the garbage (recycling = blue, waste = green / black, compost = brown) and drop it off at the location specified in your reception instructions.
5.3 In the event that a spa is present, the tenant is responsible for its maintenance during his stay and it is his obligation to ensure that he returns it in the same condition as when he arrived. He must ensure that the spa is functioning properly at all times. If there is a problem, the Tenant must immediately notify Hosts. An additional maintenance fee of $ 100 will be charged in the event that the spa is returned to an unhealthy state such that it must be emptied.
5.4 Long-distance fee + $ 10 administration fee will be charged on the credit card upon receipt of our invoice
5.5 WiFi is limited in some chalets, please refer to the chalet page on the Hebergia website in the “Commodities” section. The fees are $ 5 per additional GB
5.6 Tents, trailer tents, caravans, snowmobiles, ATVs are prohibited on the chalet.
5.7 The number of authorized parking spaces indicated in this contract must be respected and no vehicle is authorized in the neighboring streets.
5.8 The number of authorized persons indicated in this contract can not be exceeded, and this, at any time. In the event of an overrun, a fee of $ 125 per additional person will be retained from the deposit and will result in an immediate eviction of all occupants.
5.9 Unless otherwise stated, animals are prohibited inside and outside the cottages. In chalets where pets are allowed, an additional fee applies at the time of booking.
5.10 The tenant agrees not to smoke inside the cottage.
5.11 The Tenant agrees to respect reasonable rules of conduct and not to disturb the neighbors and residents of the area and to maintain a reasonable level of noise at all times, but especially between 10 pm and 7 am. To this end, the tenant agrees to be very careful when using the spa between 10 p.m. and 7 a.m. And at all times not to make fireworks.
Any violation of any of the conditions in clauses 5.8 to 5.10 will result in an additional fee of $ 500, which will automatically be charged from the deposit, for any inconvenience caused.

NON-COMPLIANCE
6.1 Failure to comply with the terms and conditions enumerated in this contract by the Tenant or his guests may result in the termination of this contract by Hébergia and will result in the eviction of all occupants without any compensation or reimbursement.
6.2 In addition, the parties shall choose as the sole competent court the courts located in Sherbrooke,
Québec, in the judicial district of Saint-Francois to dispose of all requests, claims and / or disputes related to this agreement and all related matters, the parties specifically excluding the jurisdiction of any other authority, tribunal or tribunal from any other district. In this regard, the parties elect domicile in the judicial district of Saint-François

CONSENT
The parties acknowledge having read and understood the content of this rental agreement and declare themselves satisfied with it.
